“The Client” and “The Commissioner” agree to the provisions of this Agreement which are as follows:
A. GENERAL
By ordering a Commission, you agree to these terms.
I reserve the right to stop work on a Commission or cancel a Commission request due to poor communication (rude/inappropriate behaviour) or a breach of these Terms of Service.
I have the right to alter my terms of service at any time. New rules will not apply retroactively and won't influence orders started on older terms.
B. TOPICS
I have the right to refuse the commission if I find that I cannot create such artwork.
C. ORDERING
Each price is tailored to fit an individual commission depending on wishes, complexity and character design. If you wish to get a quote, please contact me.
Quotes can be requested at any moment, even if the commission status is closed.
Commission description should contain visual reference and brief description.
D. CREATION PROCESS & REVISIONS
Each commission type will receive a sketch stage for approval and the right to revision.
Further work-in-progress updates may or may not be shared depending on clients wishes.
Major revisions depend on commission type. Major revision right applies for any kind of art of 100 EUR or more with one possible revision. Full Illustrations get up to two applicable revisions.
Edits and adjustments after the final artwork is handed to the Client are not included in the initial quote and may be charged depending on complexity.
Any additional work outside of the initial project and quote will be charged accordingly.
E.PAYMENTS & REFUNDS
A 50% upfront fee is required after both parties agree on the Commission terms and details. Only after the first payment has been received will I start working on the Commission. The remaining 50% is required after the Client has officially approved the final result. Only when the full payment has been received will the high-quality file and ownership of the Commission be transferred to the client.
All payments must be made via Invoice(Bank Transfer of Wise). I will email you an invoice once we agree to go forward with the Commission.
All invoices are due within 7 days from receiving them unless agreed otherwise. Invoices past the due date will be cancelled, also cancelling the commission associated with it.
Payments without prior invoice won't be accepted. Please include your address and contact name so an invoice can be prepared and sent.
If the Customer nonetheless does not want or refuses to receive Work, Artist may decide whether or not to complete Work and exclusively retain all rights to Work that has already been made. In this case, the first part of the payment is not returned to the Customer. Full refunds are issued only before the start of work of a particular order.
All prices are expressed in EURO (EUR), and payments are expected to be made as such. The Client is responsible for providing the correct amount, equal to the EUR amount.
I do not accept cryptocurrencies as payments.
All fees associated with the money transfer are covered by the Client.
If the order has an illustration/sketches in traditional materials, the Client must also cover the shipping costs.
F. COPYRIGHTS & USAGE
By commissioning me, the Client is purchasing my labour only. I retain all rights to the Commission, which includes but is not limited to: Distribution, reproduction, use of the Commission for Artist promotion unless otherwise agreed upon. I also retain full copyright for any preliminary designs and incidental works made in the creation of the Commission unless otherwise agreed upon.
Clients may repost watermarked art at will as long as proper credit to me is included (must include my full name Liliia Sitailo, and include a link to this website and/or to social media pages), a signature is visible and no profit is being made.
I do not claim any rights to characters and other intellectual properties used in process of creation.
The Client has the possibility to buy full rights to commissioned artwork. Details will be discussed individually.
The Client may use the digital (.jpeg, .png or .PDF) file for local printing, so long as it does not breach any Terms and Conditions, and the Client obtains expressed written permission from the Artist prior to printing.
The Client is strictly prohibited from using any original or commissioned art to partake in anything related to crypto art/NFTs.
G. OTHER
My private contact information will not be shared with clients.
The Artist has the right to pursue damages under Ukrainian Copyright Law, should there exist a violation in addition to a breach of these Terms of Service.
